Obtaining a European patent: the opposition procedure

Opposition must be lodged within nine months of publication in the European Patent Bulletin of the mention of the grant of the European patent concerned ( article 99(1) de la CBE ). After this period, it is inadmissible.

Objections must be filed and substantiated in writing, by fax or electronically (article ( article 99(1) de la CBE and règle 76 de la CBE ). Oppositions filed in a single copy must cite at least one of the three grounds for opposition and provide the necessary facts and supporting documents, failing which the opposition will be rejected...
