1. Different players in the building process

There are several types of players involved in the act of building:

public owner ;
delegated project manager ;
private owner ;
architect ;
prime contractor ;
technical controller ;
SPS coordinator ;
OPC manager ;
contractor.

1.1 Public owner

Article 2 of law no. 85-704 of July 12, 1985, known as the MOP law (maîtrise d'ouvrage publique) (amended by order no. 2004-566 of June 17, 2004) simultaneously defines the project owner and the tasks conferred on it as a result. This text is repealed by ordinance no. 2018-1074 of November 26, 2018, article 18 (V), with the exception of the last paragraph of article 1^er (
