1. Compulsory competence of a Spanc

Law no. 92-3 of January 3, 1992, on water, lays the legal foundations for the establishment of public non-collective sanitation services (SPANC). This law stipulates that communes, or their groupings, must define, "after a public inquiry :
collective sanitation zones, where they are required to collect domestic wastewater and store, treat and discharge or reuse all wastewater;
non-collective sanitation zones, where they are only required, in order to protect public health, to ensure the control of sanitation systems and, if they so decide, their maintenance". (article 35-III).
