Clarification provided by Article 2 of the Public Order Code
"Public procurement contracts are contracts concluded for valuable consideration by a purchaser or a conceding authority with one or more economic operators to meet its needs in terms of works, supplies or services".
This definition refers to a number of cumulative criteria, which make it possible to recognize the existence of a public contract.
