3. How does the procedure before the National Commission for Employee Inventions work?
The matter may be referred to the CNIS at any time by the employee, the employer or both, by means of a simple request, which may be filed with the Secretariat of the Commission nationale des inventions de salariés or sent by registered letter with acknowledgement of receipt (article R. 615-12 of
Code de la propriété intellectuelle
).
Given the implications of such a referral, it is obviously advisable to proceed by registered letter.
