3. What is the INPI administrative examination?
The purpose of the administrative examination of the patent application is to check that the filing and search report fees have been paid and that the patent application is in order.
3.1 Verification of royalty payments
Payment of the filing and search report fees is not compulsory at the time of filing, but must be made within one month of filing.
If payment is not received within the stipulated period, the claim is rejected. However, it is possible to regularize payment within two months of notification of rejection, subject to payment of a surcharge. If the failure to pay and/or to pay the increased fees is not contested, the rejection decision is final.
