How is a restriction proposed?
A restriction may be proposed by an EU Member State, or by ECHA at the request of the European Commission. In both cases, the proposal will be evaluated by ECHA's committees (the Committee for Risk Assessment and the Committee for Socio-economic Analysis), whose opinions will serve as the basis for the European Commission's legislative decision.
Are there any restrictions that everyone can apply immediately?
Yes, according to article 68.2 for CMR substances (Carcinogenic, Mutagenic or Reprotoxic) of categories 1A or 1B according to the CLP regulation (1 or 2 according to the Dangerous Substances Directive): they must not be present as substances, preparations or articles intended for consumers.
