4. Proceedings open to the parties
Obtaining an expert report is not an end in itself, as the report has no binding force. Only a settlement or a court decision can confer authority on the report, making the facts it relates indisputable.
4.1 Incentives to find an amicable solution putting an end to the dispute
Alternative dispute resolution methods are now favored by current legislation. They respond to a need – to relieve the courts – and to reason: a settlement is often preferable to a trial, due to the foreseeable uncertainty, cost and slowness of proceedings.
