5. Coordinator's responsibility
On the one hand, the coordinator cannot be held liable under the French Labor Code in the event of a workplace accident.
He has no delegated authority and as such cannot be held liable in place of the project owner or any of the employers or self-employed workers working on the site (article L. 235-5).
On the other hand, the coordinator is not a builder within the meaning of article 1792-1 of the French Civil Code, and is therefore not subject to the presumption of liability resulting from article 1792 of the same code, nor to the insurance obligation, in the case of a building operation, as defined under the conditions set out in article L. 241-1 of the French Insurance Code.
In fact, the coordinator's mission is strictly concerned with the prevention and safety of workers, and in no way with the safety of the structure...
