The French Environment Code stipulates that "any producer or holder of waste is responsible for its management until its final disposal or recovery, even when the waste is transferred to a third party for treatment". It is therefore the contractor's responsibility to ensure that his service provider is authorized to take charge of his waste, and that its management is carried out in accordance with regulations.

It should be noted that this shared responsibility cannot currently be transferred; in fact, the contractor is responsible for his waste, even when it is no longer in his care.
