In view of the potential environmental nuisance and/or risk associated with certain activities and facilities, the law stipulates that their operation must be authorized before they can be put into service.
An authorization application is required for the commissioning of activities listed in the nomenclature of classified installations subject to regime A (authorization).
An operating permit application consists of several parts, the first of which is the application itself, submitted to the Prefect. The aim of the administrative authority is not to let just anything be done, in any way, anywhere and by anyone. The administrative authority therefore requires :
to have detailed information on the project, including its location, before it is commissioned;
to know who is the author of the project, i.e. who will be responsible for its operation;
to take steps not only to inform local authorities, neighbors and the public in general, but also to solicit their opinions and observations so that the project can be modified if necessary;
regulate operating conditions, while retaining a right of oversight, with the possibility of administrative and penal sanctions if necessary.
Before compiling the operating permit file, and therefore writing your operating application, you need to list your activities and their operating conditions, and search the nomenclature for the headings likely to be concerned.
