2. How can we identify categories of legal rules?
Constitutional rules form the constitutional framework. This framework consists notably of the following rules: the Constitution of October 4, 1958, the founding text of the Fifth Republic; the Declaration of the Rights of Man and of the Citizen of 1789; and the Environmental Charter of 2004 (see Legifrance, under “French Law” then “Constitution”). Certain freedoms have also been recognized by the Constitutional Council as having constitutional value: this is the case with the freedom of enterprise and the freedom of contract.
Under French law, no legal rule may conflict with constitutional provisions.
