1. General information and basic concepts

Let's start by recalling a few legal principles.

  • Article 9 paragraph 1 of the French Civil Code states that: "Everyone has the right to respect for his or her private life. This means that everyone has the right to object to the reproduction of his or her image, or to the broadcasting of any comment relating to his or her private life.

  • The principles of privacy and personal data protection are enshrined in Articles 7 and 8 of the Charter of Fundamental Rights of the European Union.

  • Directive 95/46/EC of the European Parliament and of the Council aims to harmonize the protection of individuals' fundamental rights and freedoms with regard to processing activities, and to ensure the free flow of personal data between Member States....
