4. Understanding the Obligations Related to the Use of a Substance in the Manufacture of an Article

As an importer, you are considered a supplier of the article. You may be subject to two legal obligations if an SVHC is one of the constituents of the imported article:

  • an information requirement;

  • a notification obligation to the French Chemicals Agency (ECHA).

4.1 Information Obligation

Immediately upon a substance’s inclusion on the Candidate List, suppliers of articles containing one or more substances on the Candidate List in a concentration of 0.1% or more (weight by weight) must provide customers, upon request and within 45 days, with sufficient information to enable the safe use of that article.
