The regime applicable to employee inventions is designed to determine whether the employee inventor or the employer holds the rights to the invention and can apply for a patent.
Within this framework, the
Code de la propriété intellectuelle
provides for three distinct categories (article L. 611-7):
Mission inventions: these are inventions made by the employee in the performance either of his or her employment contract, involving an inventive mission corresponding to his or her actual duties, or of studies and research explicitly entrusted to him or her, and belong to the employer.
