4. Parks annexed to workplaces

The definition of the workplace is that of EEC directive no. 89654. This definition of the workplace covers all areas located inside or outside the establishment's buildings intended to accommodate workstations and, more generally, to which the worker has access in the course of his or her work. This includes, in particular, all ancillary premises for collective use, all clearances and accessible spaces, as well as maintenance workstations and areas. Naturally, the frequency of access to maintenance areas or occasional workstations will enable us to assess what is reasonably practicable, notwithstanding the application of specific regulations.

However, the provisions relating to workplaces do not apply to common areas, including janitor's lodges, in buildings used mainly for residential purposes. (Labour Code, art. R 232-1).
