4. Procurement procedures

Public works contracts and concessions differ in the way they are awarded.

• In the case of concessions, public authorities have greater freedom to negotiate, and the choice of concessionaire by the grantor is less restricted. However, a number of procedural rules are laid down (§ 4.4 ).

• Public works contracts, on the other hand, are subject to a proper procedure. In this respect, the situation is very different from that for private works contracts
