2. Public works contracts and concessions
The legal framework governing public works contracts and, to a lesser extent, concessions, is largely of legal and regulatory origin, and is much more codified than that governing private contracts, where the principle of contractual freedom still plays an important role. These non-conventional provisions are general in nature, and apply in principle to all administrative contracts in the same category, for example all works contracts awarded by a public authority, or to the same category of concessions.
However, these provisions may be subject to exceptions, with public authorities always reserving the right to define ad hoc regulations for certain types of operation, when circumstances so require.
