6.1 Law 71-584 of July 16, 1971 (JO of July 17 amended by law no. 72-1166 of December 22, 1972 (JO of December 28, 1972)

Article 1 ^er – Payments on account in respect of the final value of private works contracts as referred to in article 1779-3 of the French Civil Code may be reduced by a deduction equal to no more than 5% of their amount, as a contractual guarantee that the work will be carried out to satisfy any reservations made by the client on acceptance.

The project owner must deposit a sum equal to the amount withheld in the hands of a consignee accepted by both parties or, failing this, appointed by the President of the Tribunal de Grande Instance or the Tribunal de Commerce.
