2.1 Legislation in force in France
In France, RTE, as a TSO, is responsible for guaranteeing system reliability. It is therefore responsible for supplying system services. To provide these services, RTE relies on auxiliary services supplied by producers who have signed a system services participation contract. This arrangement was defined by law no. 2000-108 of February 10, 2000 on the modernization and development of the public electricity service: "RTE must ensure the availability and implementation of the services and reserves required for network operation. To this end, RTE must negotiate freely with the producers and suppliers of its choice the contracts necessary for the performance of its missions, in accordance with competitive, non-discriminatory and transparent procedures"...
