No, you'd be subject to formal notice to comply within a specified timeframe.
What risks does the operator run if he refuses to comply with the formal notice?
In such cases, operators are liable to administrative and criminal penalties.
Who pays for third-party sampling and analysis requested by the inspector?
It is your responsibility to cover these costs. You cannot refuse to have them carried out on the grounds of cost, even if your financial situation is delicate. The prefectoral administration gives precedence to the protection of interests protected by the ICPE police, including the protection of the environment, health and safety, over your private interests.
