Is the non-technical summary of the impact study mandatory for all DAE files?
Yes, the absence of a summary in an EAD file found by a court of law constitutes an irregularity which may invalidate the current procedure and oblige the petitioner to submit a new, complete file (cf. Conseil d'État decision of June 28, 1999, commune de Saint-Martin-de-Bellevue et Association contre la très haute tension aérienne au nord d'Annecy, req. n° 186921 et 186922, tables du Rec. Lebon).
Where should the non-technical summary of the impact study be placed?
No matter. The regulations do not impose any specific location. It can be placed at the beginning of the study or at the end. The important thing is that it should be identified in the file summary for easy access.
