3. How do you prove compliance with the general safety obligation?

According to the General Product Safety Directive 2001/95/EC, a product's compliance with the general safety requirement is assessed by taking into account :

  • specific Community and national regulations governing product safety;

  • non-mandatory national standards transposing European standards or standards specific to the country of sale;

  • Commission recommendations establishing guidelines for product safety assessment;

  • codes of conduct in force ;

  • the current state of knowledge and technology;

  • the safety that consumers can reasonably expect.
