Litigation. Responsibilities

Decisions relating to classified facilities (like any other administrative decision) may be appealed on grounds of abuse of authority, both by the operator and by third parties (individuals, associations, local authorities).

These appeals may concern a refusal or authorization to operate, or the content or inadequacy of the technical requirements laid down in the prefectoral decree. They must be lodged in the first instance with the administrative court responsible for the facility concerned. The judgment may be appealed to an administrative court of appeal, and the appeal in cassation to the Conseil d'Etat.
