4. Identify the penalties incurred

Fines and/or imprisonment are the two main penalties, but there are also complementary penalties which can be imposed in addition to fines and/or imprisonment.

4.1 Principal penalties

The situation varies depending on whether the offence is a contravention, délit or crime.

In addition, the legislator has defined penalties for legal entities (articles 131-38 and 131-39 of Code pénal ).

The penalty for contraventions is defined by regulation (decree, order). The penalty is a fine, the amount of which varies according to the class of contravention.
