4. Odors and legislation governing classified installations (ICPE)

Legislation on classified facilities is based on the July 19, 1976 law on facilities classified for environmental protection (ICPE), which repealed the December 19, 1917 law on "dangerous, unhealthy and inconvenient establishments".

The provisions of the Law of July 19, 1976 were incorporated into the Environmental Code by the Order of September 18, 2000. The purpose of the 1976 law is to make "factories, workshops, depots, construction sites and, in general, installations [...] which may present dangers or inconveniences [...] for the convenience of the neighborhood [...]" subject to State supervision (article L. 511-1 of the Environment Code).

The facilities concerned are defined by decree and listed in the ICPE nomenclature (article R. 511-9 of the Environment Code). Until 2009, these facilities were subject to authorization or declaration,...
