Can the information contained in the project certificate be used to contest the environmental permit?

The information contained in the project certificate cannot be invoked in support of an appeal against the environmental authorization subsequently issued. It is therefore not possible to obtain the annulment of this authorization by arguing that the information contained in the project certificate is erroneous or incomplete.

However, the administration may be held liable for any inaccuracy in this information, or for any failure to comply with the commitments set out in the timetable, which may have caused prejudice to the beneficiary of the certificate. It is therefore possible to hold the administration liable and obtain an order to pay you damages if the judge finds that the administration is at fault and that you have suffered prejudice....
