6. Conclusion

French regulations, combined with a genuine policy on polluted sites and soils from the French Ministry of Ecological Transition, have placed a number of obligations on ICPE operators in terms of preventing and managing soil pollution, as well as rehabilitating sites at the end of operations.

However, the problem of soil pollution is no longer managed exclusively within the framework of regulations governing classified facilities.

Initially, waste regulations were also applied, which gave rise to a number of questions concerning their articulation with ICPE regulations. However, these issues have recently been largely resolved by legislative and regulatory changes since 2010, as well as by developments in case law.
