1. Contract benchmarks

  • First of all, we need to identify the stakeholders in the French legal context in which we have chosen to operate. In French legal terminology, the customer is usually referred to as the "Maître de l'Ouvrage" (sometimes also referred to as the "contracting authority", "donneur d'ordre", etc.). For practical reasons, he will be referred to as "Customer" in all studies relating to engineering contracts.

    The provider of intellectual services who calls on a significant proportion of "grey matter" is usually referred to as the "prime contractor". This term is retained in these articles. It designates the natural or legal person who, for his technical competence and within the framework of a Contract, is entrusted by the Customer with designing and/or directing and controlling the execution of work by suppliers (hereinafter referred to as "Enterprises")...
