1. Find out what the Élan law requires

The scope of each party's responsibilities is defined in the lease. The types of buildings concerned include the following:

  • offices ;

  • buildings dedicated to teaching ;

  • administrative buildings ;

  • logistics (including cold storage) ;

  • datacenters.

For monitoring purposes, the energy consumption of the buildings concerned must be sent to the OPERAT (Observatoire de la performance énergétique de la rénovation et des actions du tertiaire) IT platform managed by ADEME from 2022 onwards. Failure to comply with this obligation can result in a fine of up to 7,500 euros.
