4. Procurement procedures
Public works contracts and concessions differ in the way they are awarded.
In the case of concessions, public authorities have greater freedom to negotiate, and the choice of concessionaire by the grantor is less restricted. However, a number of procedural rules are laid down (§ 4.4 ).
Public works contracts, on the other hand, are subject to a proper procedure. In this respect, the situation is very different from that for private works contracts
