The purpose of this article is to review and describe the content of the several documents included in the execution of a works contract (public or private).The execution of a works contract is part of a comprehensive construction operation involving various economic operators not necessarily linked together by a contract. The multiplicity of its participants fulfills different but complementary objectives. Consequently, it is important to understand the limits of each participant's mission, and how they coordinate their assigned tasks.
This article deals with the impact of BIM on architecture. After a recall of the structure of architecture agencies and the architect’s work itself, the consequences of BIM on this fast-evolving activity are shown.The process of architectural design is underlined along with the compilation of data related to all disciplines. The article describes the required skills, those to be learned, and trends in the architect’s role among the various trades involved. It gives some background to the BIM process to successfully transition from traditional methods to the new ones using new technologies.Examples are also presented to illustrate the BIM process in different project phases.Finally, mention is made of fees, the law governing public contracts, and the readjustments needed.
In France, the execution of works contracts, whether private or public, is followed by a ten-year period during which the liability of builders may be sought in the event of disorders of a certain importance. In addition, as is the case for driving a motor vehicle, the law makes it compulsory for clients and builders to take out insurance policies covering this liability.It is therefore logical to devote a specific development to it : it is the object of this article.
Difficulties encountered in the execution of works contracts often require the use of experts to provide an opinion on the solutions to be applied. In France, judicial expertise, because of its authority, is often preferred to amicable expertise which is not binding. However, the conduct of a judicial expertise and its outcome require knowledge of the legal framework in which it is carried out as well as the consequences that may be attached to it.This section deals with the modalities and possible consequences of a judicial expertise, both in public procurement and private contracts.This article aims to inform the decision makers (engineers, project managers) of the stakes and advantages of obtaining a legal expert report on a technical litigation.
The legal status of public works contracts requires that any such contract (determination of the parties), and the main issues raised by their conclusion (procurement procedures) be defined in advance. The modalities of their administrative and financial execution, the problems of responsibilities and insurance, and litigation, are addressed in this article.
