4. Conversion from authorization A or declaration D to registration E

A facility covered by the authorization or declaration regime may be subject to the registration regime, following a revision of the thresholds for the relevant heading.

The principle of grandfathering also applies in this case, provided you have informed the prefect of the change in classification regime within one year of publication of the decree modifying the nomenclature. You continue to apply your prefectoral authorization order or the general requirements of the ministerial order for the declaration heading. However, as some of the general requirements of the ministerial decree on registration are directly applicable to existing facilities, you must ensure that your facilities comply with these new requirements.
