3. What are the effects of a delegation of authority?

3.1 With regard to the delegator

The delegation of authority transfers your personal criminal liability to the delegate. This means that compliance with ICPE regulations is now the responsibility of the delegate, and that in the event of an infringement, you cannot be convicted.

As an exception, you may be convicted if it is shown that you participated in the commission of the offence:

• or as an accomplice, for example in a situation where you have provided secondary assistance to the delegatee;
