3. Identify the cases in which criminal liability can be invoked

Criminal liability is triggered every time an offence is committed.

In addition to the offences defined by the regulations governing ICPEs, there are other common law offences that can affect the operation of an ICPE.

3.1 Infringements defined by ICPE regulations

ICPE regulations define the following offences:

  • commissioning of a Class A plant without authorization ;

  • commissioning of a Class E plant without registration ;

  • commissioning of a class D plant without declaration ;

  • non-compliance with technical specifications ;

  • failure to declare modifications...
