2. Identify the steps in the procedure

The implementation of criminal liability involves several phases:

2.1 Victim's report and/or complaint

Two circumstances may lead to criminal prosecution:

  • Filing a complaint by the victim of the offence: the victim can file a complaint, in order to denounce the offence and request the imposition of a criminal sanction (fine and/or imprisonment) against the perpetrator; when the complaint is filed as a civil party, the victim requests, in addition to the imposition of a criminal sanction (fine and/or imprisonment), compensation for damages from the perpetrator.
