3.1 Plant variety protection

Plant breeding is specifically protected by the issue of a plant variety certificate.

A plant variety is defined as a new variety created or discovered:

  • which differs from similar known varieties in one important, specific or only slightly fluctuating characteristic, or in several characteristics, the combination of which is such as to give it the quality of a new variety;

  • which is homogeneous for all these characteristics;

  • which remains stable, i.e. identical to its initial definition at the end of each multiplication cycle.
