Who appoints the investigating commissioner?

The CE is appointed by the president of the administrative court to which the department where the project is located is attached. He or she is chosen from a list of members qualified to perform this function (there is a list of qualified members in each département).

The selection criteria are at the sole discretion of the Chairman.

Is the investigating commissioner independent?

The CE approached by the president of the TA can refuse to conduct an investigation for various reasons (unavailability, because he or she does not feel sufficiently competent on the subject, etc.).

He must also refuse the proposed survey:

  • if affected by the project ;
