1. Identify the civil liability players

The implementation of civil liability involves three players:

  • the victim of the loss (the claimant) ;

  • the person being sued (the defendant), who may be the operator of the ICPE, either a natural person or a legal entity;

  • the civil judge.

1.1 The victim of the loss (the claimant)

The term "victim" refers to the person seeking compensation for the damage caused by the operation of the IPCE.

Several types of damage can be identified:

  • physical damage: the operation of an ICPE may have caused illness, or more exceptionally, injury in the event of fire or explosion,...
