4. Identify the penalties incurred under civil liability law

4.1 In the presence of a contract

Civil liability results in damages and/or the annihilation of the effects of the contract for the future (termination), or even for the past (resolution).

For example, in the case of a contract for the sale of polluted land, the seller may be ordered to pay damages to the buyer, and the contract of sale may be rescinded, which implies that :

  • the seller returns the purchase price to the buyer;

  • the buyer returns the polluted property to the seller.

The contractor may also request site restoration at the seller's expense.
