What is a special requirements order?
In most cases, the operator of a classified facility subject to declaration is only required to comply with general regulations. However, in two cases, these general requirements may be supplemented by a special requirements order, once the facility has been commissioned.
Where environmental protection is not guaranteed: interested third parties (environmental protection associations, neighbors, local authorities, etc.) who consider that environmental protection is not guaranteed by compliance with the general regulations may refer the matter to the prefect, asking him to impose stricter operating regulations on the facility. The authorities can also take the initiative in issuing special regulations (to protect groundwater, for example).
