Do ministerial decrees on general requirements apply to declared facilities operating within an establishment that is also subject to authorization?
Such cases are very common in plants operating installations subject to authorization and declaration.
As a matter of principle, the prefectoral operating authorization order incorporates all applicable regulatory provisions, and regulates not only authorized facilities, but all those likely to interact with them, whether classified or not.
For this plant's declared facilities, the prefectoral decree must, in principle, incorporate the provisions of the ministerial prescriptions in force. In legal terms, these orders are not applicable as such.
