2. Find out if you can benefit from a penal transaction

The penal transaction concerns all environmental offences constituting a contravention or a délit.

This does not apply to the first four classes of contraventions (contraventions punishable by a fine of between 38 and 750 euros maximum). These offenses can be settled by payment of a fixed fine, which has the effect of avoiding criminal prosecution. In this case, there is no need for a penal transaction.

Please note that the penal transaction can only be implemented if the public prosecutor accepts it. His refusal may therefore constitute an obstacle to any transaction.
