4. Our advice

4.1 Ask the administration as soon as possible about the possibility of a penal transaction

A penal transaction can only be implemented if criminal proceedings have not already been initiated. If the public prosecutor or the victim has already referred the matter to the criminal courts, it is no longer possible to consider a penal transaction. It is therefore important to react quickly, by officially asking the prefectural authority if it agrees to draw up a penal transaction proposal.
