1. Identify your consultation obligations

Decisions relating to ICPEs subject to declaration (D) or declaration with periodic control (DC) are not subject to prior consultation with the public.

They are in fact considered to be low-pollution, low-hazard facilities, the opening of which is subject only to prior declaration. If the declaration file is complete, the prefectoral authority is obliged to issue the receipt required for operation. It therefore has no discretionary power, and under these conditions, no prior consultation procedure with the public is provided for.
