4. Mistakes to avoid

4.1 Don't obstruct inspection

The inspector is not obliged to obtain the operator's agreement to a visit. Obstructing inspectors in the performance of their duties is an offence punishable by six months' imprisonment and a fine of 15,000 euros. In addition, inspectors are protected by the provisions of the French Penal Code relating to contempt of persons carrying out a public service mission.

Important

You cannot refuse to have samples and analyses taken of the emissions from your facilities.

The inspector may assign an analysis laboratory to carry out sampling, analysis or controls at one or more specific points of a classified facility, outside his or her presence.
