4. Mistakes to avoid

4.1 Do not leave a site on which an ICPE has been operated without carrying out restoration work.

In terms of civil liability, you risk being ordered to pay damages and/or carry out remedial work, at the request of one or more victims of pollution resulting from failure to remediate.

In terms of administrative liability, the prefect can compel you to carry out the restoration work, after a formal notice has been served but has failed, by requiring you to deposit a sum of money corresponding to the cost of the restoration work with the Public Treasury.

In terms of criminal liability, failure to comply with a formal notice to take, within a given timeframe, measures to monitor or restore a facility or its site following cessation of activity...
