2. Understand the issues involved in identifying non-conformities
2.1 What does non-conformity mean?
A finding of non-compliance by the environmental inspector means that you are not complying with the rules applicable to you under the ICPE regulations.
This situation covers three main situations:
Operation of the ICPE does not comply with the obligations imposed by ICPE regulations. For example, the facility is operated in disregard of the technical requirements set out in the prefectoral authorization order, or of the standard requirements laid down by ministerial order for facilities subject to the declaration or registration regime; or the facility has not been rehabilitated after it has been shut down, in violation of the reclamation obligation set out in the ICPE regulations....
