7. Mistakes to avoid

7.1 Don't assume that non-classification relieves you of all environmental obligations

The non-classification regime does not mean that you have no environmental obligations to meet. It only implies that :

  • you are exempt from declaring, registering or requesting authorization under ICPE regulations;

  • for operation and closure, you do not have to comply with any technical requirements under the same regulations.

Nonetheless, you are required to take care not to pollute, in compliance with existing national regulations. What's more, in the event of proven pollution, the prefect may give you formal notice to cease and remedy the situation within a given timeframe. If you...
