5.1 Check the public buyer's compliance with procurement procedures

Regardless of the consultation procedure used, the public purchaser is bound either by the rules set out in the French Public Procurement Code (invitation to tender, procedure with negotiation, competitive dialogue), or by the rules he has freely set and announced to the candidates (adapted procedure).

Any discrepancy constitutes an illegality that may be censured by the judge.
